All payments/deposits will follow our “No change of mind” refund policy. If a refund can be given then it will be done so on an individual contract bases as to be determined by the BREEDER. No Cash refunds will be provided at any time. In the event a refund is required it will be given as a credit card refund, money order or cashier’s check within 90 days of the refund initiated date by the kennel. No refund will be given for but not limited to: puppy personality, compatibility, gender, color/markings of the puppy, change of mind, after taking the puppy home, etc..If a dispute over a refund arises then the Buyer understands that the BREEDER will make the final decision on the refund issue. If for any reason the BUYER does not want the puppy then the BUYER must inform the BREEDER in writing of this request and the BUYER will not be entitled to a refund or a puppy any longer. The refund policy is subject to change at any time at the kennel discretion.
All deposit/preorder deposits are non-refundable. If a refund is given it is given at the Breeders discretion. The kennel cannot control uncontrollable factors to do with a bred female or heat cycle as these are acts of mother nature. The kennel can give the best-educated guess of whelping dates based on the available evidence.
Until the Buyer has fulfilled their contract obligations the Breeder will still have legal ownership of the puppy even if the puppy is not in the Breeders possession at the time.
We reserve the right to refuse any transaction to any current or potential buyer if they threaten the kennel in anyway or fashion if they do not complete terms of the contract or indicate they would not have bought a puppy from us.
Buyer agrees to have the puppy neutered/spayed before the puppy is 6 months old per this contract. If the puppy has not been spayed/ neutered before it turns 6 months of age then the Buyer will be required to pay the Seller a penalty fee of $5000.00 and if further legal action is required to enforce this contract; buyer will be required to pay additional fees (i.e. attorney fee, court cost). Buyer must submit proof of sterilization from a veterinary office/clinic. Buyer will have a (7) day grace period in which the puppy must be sterilized or the Buyer will be in breach of contract. If a breach of contract occurs, the Buyer must relinquish the puppy. If the Buyer refuses to relinquish the puppy the Breeder has the legal right to seek further legal action to repossess the puppy and will be required to pay the Breeder a breach of contract fee which is equal the total cost of the puppy plus a penalty fee. Failure to have the puppy sterilized by the deadline date will result in further legal action against the Buyer and Buyer will be required to pay a failure to perform penalty fee of $5,000 payable to the Breeder in court. Buyer must supply Seller with proof of sterilization of the puppy being sterilization before the deadline date. Failure to do so void any right to registration papers on said puppy. The verification form must be either a signed letter from Buyer’s Veterinarian or a receipt that shows the Clinic, contact number to the clinic and Veterinarian that performed the sterilization. All information must be verified before this contract can be considered fulfilled.
This puppy has a 2 year warranty which includes if the puppy becomes sick and dies and it is determined that it is a cause of something related to the kennel, hereditary or anything that relates to the puppy having it before it left the kennel, or if the puppy is killed by un-natural related causes (hit by car) then the Seller will exchange the puppy of a different litter, from Breeders breeding stock, of the Buyers choice regardless of price. If the dog is stolen the kennel will replace the puppy only if a valid police report is presented on the theft. If it is determined that was stolen only to get another puppy then the proper legal actions will follow. If an illness is due to breeding or hereditary and the puppy is still alive Buyer must relinquish the present puppy to receive the new (replacement) puppy. In the event there is a hereditary illness from the breeding line detected within the purchased puppy this warranty will cover the reimbursement medical cost to the buyer. This warranty is non-transferable unless approved by Breeder. • If this puppy is bought with breeding rights both BUYER and SELLER acknowledge the above section on sterilization of the puppy is not to be enforced. BUYER will not be required to have the puppy sterilized and shall be allowed to breed the puppy at BUYER discretion per contract guidelines. ~~• Buyer agrees to have the puppy neutered/spayed before the puppy is 6 months old per this contract. If purchasing a “miniature” basset hound. Buyer understands that is not yet a registered breed of this classification with any registry within the United States. This is a designer breed. Created by breeding down the breed of purebred basset hounds. The term “miniature basset hound” describes a new breed of the basset hound. These puppies are breed to be healthy, smart, good temperament, and smaller than what is known as a “Standard Basset Hound”. These puppies are bred to be 10-35lbs and 12-14 inches at the shoulder. Though this is ideal for this new breed, this may not always be the exact outcome for this is a “new” breed and with it being “new” the results may not be accurate. We as the Breeder are determined to create a smaller lap dog/companion versions of the basset hound and in doing so better allow new owners to get the breed they love but in a smaller size. The “miniature” will have the same health and genetic problems as its larger counterpart, as well as its coat colors/markings, hunting instincts and personality traits of a basset hound.
All promos, unless specified, only apply to new customers for pre-order or current litter(post whelped) contract purchases. Promo codes cannot be used on any current in place contracts as contract terms cannot be changed.
The Kennel reserves the right to change delivery/pickup dates.
The warranty expressed in the kennels contracts is only valid for the puppy purchased from the kennel. At no point in time can it be transferred to any other person besides the expressed BUYER’S spouse If this puppy is transferred to another owner without notifying the BREEDER then the BUYER may be subject to fee’s or fines as established by the current laws of the Breeder’s state. The 1-year limited warranty only covers the replacement of a sick or diseased animal if a licensed veterinarian has deemed that the illness/disease did not come from neglect of the BUYERS. The full warranty includes everything in the limited warranty plus accidental death and thief coverage. Accidental death replacement is only valid if a licensed veterinarian has deemed that the puppy died from an “accident” such as getting ran over by a car. An autopsy must be done on the animal mentation in this contract by a licensed veterinarian within 48 hours of death in order for BUYER to place a claim on this warranty. If the dog is stolen the kennel will replace the puppy only if a valid police report is presented on the theft. If it is determined that the animal was only stolen to get another puppy then the proper legal actions will follow. There are 30 days waiting period on all stolen dog claims before a replacement dog can be given the BUYER. The full comprehensive warranty will cover only eligible animal clinic reimbursements of up to $1000.00 per warranty year. Eligible expenses are to be determined by the kennel and its policies. The Kennel will not reimburse funds already taken care of by a 3rd party such as a pet insurance provider. If animal replacement is an option and the animal is deceased and all terms and conditions have been met the BUYER will have the option get another puppy of the same breed when the next available litter has been whelped. BUYER must keep said puppy on NuVet Plus for the entire term of the warranty and use the order code 19831 when making an order online or by phone. If BUYERS fails to have said puppy on the supplement at any time during this warranty period then BUYER forfeits rights to this warranty. BUYER must keep the said puppy up-to-date on required vaccinations, worming, and heartworm prevention medications. Buyer must have the said puppy check by a licensed veterinarian at least (1) time a year for any health problems. If any exists BUYER must inform the Breeder of the problems. BUYER must feed the said puppy one of the following brands of dog food: Royal Canine, Science Diet, Purina, Eukanuba, Blue or Iams. However, BUYER can feed their puppy/dog any dry or wet food they prefer including a raw diet except for anything associated with the “Ol’Roy” Brand dry or wet food. Failure adheres to these conditions so will void this warranty. The replacement puppy will be from the next available litter that the BREEDER has available at the time. The replacement puppy will be as closely similar to the puppy in question as far as color/marking and gender are concerned. The BREEDER will pick the replacement puppy out at their discretion. A new contract will be required to obtain the new replacement puppy but the warranty will not “restart”, as terms of a new warranty. Any disagreement with this warranty or terms of this contract will be handled in the court system of the Breeder’s Kennel county and state.
If the puppy has a 1 year limited warranty which includes if the puppy becomes sick and dies and it is determined that it is a cause of something related to the kennel, hereditary or anything that relates to the puppy having it before it left the kennel then the KENNEL will exchange the puppy from a different litter from KENNEL breeding stock of the KENNELS choice regardless of price difference. The replacement puppy must be of the same breed. If an illness is due to breeding or hereditary and the puppy is still alive BUYER must relinquish the present puppy to receive the new (replacement) puppy. This warranty is non-transferable unless approved by Breeder. All breeding stock is tested according to the kennels standard to ensure that the healthiest puppies are produced. The kennel runs limit background checks on all applicants to ensure that correct information is used to determine approval. The kennel will not deny base on any protected class. A criminal charge/conviction, history of breach of contract/agreements, the false information presented at any time, or threatening or objective attitude against an animal or company may be a cause of a denial at the application stage. All breeding program dogs may not be owned directly by the kennel.Such cases the breeding stock is monitored by the kennel temporarily with no consideration in return and offspring are owned by the kennel.
